IMPORTANT: READ CAREFULLY BEFORE SIGNING
This agreement (“Agreement”) is entered into by and between [Facility Name], its officers, employees, agents, and affiliates (collectively referred to as “Facility”) and the undersigned participant (“Participant”). By signing below, the Participant acknowledges and agrees to the following terms and conditions:
1. Assumption of Risk
The Participant understands and acknowledges that participation in sports and athletic training activities at the Facility involves inherent risks, including but not limited to, physical injury, disability, or death. The Participant voluntarily assumes all risks related to participation in such activities, and acknowledges that no facility, equipment, or supervision can eliminate all potential risks.
2. Release and Waiver of Liability
In consideration for being allowed to participate in the Facility’s activities, the Participant, on behalf of themselves, their heirs, assigns, and personal representatives, hereby waives, releases, and discharges the Facility, its owners, employees, agents, and affiliates from any and all liability for injuries, damages, or losses sustained during or in connection with participation in any of the Facility’s activities, whether caused by negligence or otherwise.
3. Health and Fitness
The Participant certifies that they are physically fit and capable of engaging in sports training activities. The Participant agrees to notify the Facility immediately if they are injured, unwell, or unable to continue any activity. It is the Participant’s responsibility to ensure they have received appropriate medical clearance prior to engaging in any physical activity.
4. Indemnification
The Participant agrees to indemnify and hold harmless the Facility and its affiliates from any claims, damages, costs, or legal fees arising from the Participant’s actions or omissions during participation in the Facility’s activities.
5. Medical Emergency
In the event of a medical emergency, the Participant authorizes the Facility to obtain emergency medical treatment, and agrees to bear all costs associated with such treatment.
6. Media Release
The Participant grants permission to the Facility to take photographs, video, or other media recordings during the activities and to use such media for promotional purposes, unless the Participant explicitly requests otherwise in writing.
7. Governing Law
This waiver and release shall be governed by the laws of the state or country in which the Facility is located. Any disputes arising under this Agreement will be resolved in the appropriate courts within that jurisdiction.
8. Acknowledgment
By signing below, the Participant acknowledges that they have read, understood, and agree to the terms of this waiver and release. The Participant further acknowledges that they have had the opportunity to ask questions and have all questions answered to their satisfaction.
